New York Court Orders Joint Trial for Gautam Adani Bribery Cases

In a significant legal development, a New York court has ruled to combine three ongoing cases against Indian industrialist Gautam Adani and others, centered on allegations of USD 265 million in bribery. The decision ensures a joint trial for the related cases to streamline judicial proceedings and avoid scheduling conflicts.

Details of the Ruling

The court order, issued on December 12, 2024, by the Eastern District of New York Court, stated that the cases stemmed from overlapping allegations and transactions. Consequently, the court consolidated the following cases:

  1. US vs Adani and others (criminal case against Gautam Adani).
  2. Securities and Exchange Commission (SEC) vs Adani and others (civil case).
  3. SEC vs Cabanes (civil case against co-accused).

To manage the consolidated cases, the court assigned them to District Judge Nicholas G. Garaufis, who is already presiding over the criminal case against Adani. Magistrate Judge James R. Cho will oversee pre-trial procedural matters, referred to as “pre-trial non-dispositive matters.” These typically involve procedural motions and preliminary legal issues that prepare the cases for trial.

The court emphasized that consolidating the cases would promote judicial efficiency and ensure consistency in proceedings.

Background of the Adani Bribery Case

The allegations against Gautam Adani and other defendants involve claims of paying USD 265 million (approximately ₹2,029 crore) in bribes to secure solar energy contracts with state electricity distribution companies. US prosecutors further allege that Adani’s company failed to disclose this bribery to US banks and investors, from whom they raised funds for the solar projects.

Adani Group’s Response

The Adani Group has vehemently denied the allegations, labeling them as “baseless.” A company spokesperson reiterated their commitment to legal compliance, stating, “We are a law-abiding organization, fully compliant with all laws. These charges are based on allegations, and the defendants are presumed innocent until proven guilty.”

Significance of the Decision

The consolidation marks a crucial step in handling this high-profile case, with potential implications for the Adani Group’s global reputation. The joint trial will allow for a more streamlined legal process, avoiding redundancy and ensuring consistency in evidence presentation and judicial rulings.

With District Judge Nicholas G. Garaufis at the helm, the trial is expected to address both criminal and civil dimensions of the case in a comprehensive manner. The next phase will involve pre-trial preparations and scheduling for the joint trial.

The reassignment of the cases was completed on December 18, 2024, with pre-trial hearings now under the supervision of Magistrate Judge Cho.
